1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of the Preset Generator service (the "Service"), operated by Preset Generator ("Preset Generator", "we", "us", or "our"). By creating an account or using the Service, you enter into a binding agreement with Preset Generator.

2. Acceptance of these Terms

By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. You confirm that you are of legal age in your jurisdiction and, where you use the Service on behalf of an organisation, that you have authority to bind it.

3. The Service

Preset Generator is an AI-powered tool that analyses reference photographs you upload and generates Adobe Lightroom presets (XMP files) intended to approximate the look of those references. Output quality depends on inputs and may vary between runs.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for unlawful, fraudulent, or abusive purposes;
  • upload content that infringes intellectual property, privacy, or publicity rights, or that you do not have permission to use;
  • submit illegal content, hate speech, sexual content involving minors, harassing material, malware, or content designed to deceive (including deepfakes of real people without consent);
  • attempt to jailbreak, reverse engineer, probe, or otherwise interfere with the security or integrity of the Service;
  • scrape, spam, or place excessive automated load on the Service;
  • resell, redistribute, or sublicense the Service or its outputs in bulk without our written permission, or circumvent technical limits.

5. Generative AI: your inputs and our outputs

You are solely responsible for the prompts and reference images you submit, for verifying that you have the rights to use them, and for how you use the resulting presets and any edited photographs. AI outputs may be inaccurate, incomplete, or unsuitable for a given purpose; you must independently review them and not rely on them for regulated professional advice. As between you and Preset Generator, you retain ownership of your inputs and of the presets generated for you, subject to the licences in section 8. We may filter, refuse, or remove outputs that violate these Terms.

If you believe content on the Service infringes your rights, contact us at hello@presetgenerator.com with details. We will review takedown requests and may suspend or terminate accounts of repeat infringers.

6. Accounts and credentials

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

7. Payments, subscriptions and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, subscription renewal, and cancellation mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period and you keep access until then. Credit packs are non-recurring.

8. Intellectual property and licence

The Service, including its software, models, design, branding, and documentation, is owned by Preset Generator and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service and the presets generated for you within the limits of your plan. You grant us a limited, worldwide, royalty-free licence to host, process, and transmit your inputs solely to operate, secure, and improve the Service.

9. Service availability and warranties

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or will produce specific results. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.

11. Indemnity

You will defend and indemnify Preset Generator from claims arising out of your inputs, your use of outputs, your breach of these Terms, or your unlawful use of the Service.

12. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination, your right to use the Service ends; we may delete account data after a reasonable period.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Preset Generator is established, without regard to conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law provides otherwise.
